General Data Protection Regulation (GDPR)

New Privacy Law Alert

On May 25, 2018, a new data privacy law called the General Data Protection Regulation (GDPR) will be enacted. Companies all over the globe are now required to change their process for business data collection, storage, and data use regarding individuals who live in the European Union (EU).

As a result, Arborgold team is proactively making development changes to Arborgold Cloud to be in accordance with these new privacy Laws.

What is Arborgold doing about GDPR and how does it affect you.

Data Protection Offer: We’ve designated a DPO at Arborgold who will manage and oversee regulation compliance and requirements. If you have questions regarding our DPO, please contact us via website chat or via email at [email protected].

Cookies: Arborgold uses both first and third-party cookies on their public and private client websites. Depending on your country of residence, you may now see a pop up message reminding you that we use cookies to improve the user experience, site speed, and provide tracking history.

Right to erasure: In accordance with GDPR, customers who reside and service contacts within the European Union will have a right to “forget” contacts from their Arborgold database. As a reminder, these requests must be completed within 30 days.

Lawful marketing consent: Arborgold customers who use the “Web to Lead Form” feature will be required to include an unchecked checkbox with specific language related to your privacy policy and website terms of use. This complies with both the US Can Spam Act as well as the GDPR Guidelines. If you do not currently have a privacy policy listed on your website, we highly suggest you create one and post without delay. Backups and retaining data: In accordance with GDPR, Arborgold will continue to store encrypted backups of your data sets, but only for 90 days. This means that requests for data restoration, older than 90 days, cannot be honored or granted.

End-User License Agreement: We’e updated our user license agreement for both the Arborgold cloud and Arborgold mobile app products in reference to these new regulations.
